Who regulates banking and financial services in your jurisdiction?

The Commission for the Financial Market (Comisión para el Mercado Financiero or CMF) exercises direct oversight over banking and financial institutions and financial services covered under the Fintech Act in Chile. Further, the Central Bank of Chile issues regulations regarding financial services, payment system through cards and other means of payment in Chile.

An independent public entity, the Financial Intelligence Unit (UAF), created by the Anti-Money Laundering Act (Law 19,913) supervises and monitors compliance with anti-money laundering laws and regulations.

The UAF requests, verifies and examines the information of reporting institutions subject to the Anti-Money Laundering Act and may apply fines in case of breach of compliance obligations. If the UAF detects suspicions of an actual money laundering offense, it must report to the criminal prosecutor, which will conduct the corresponding criminal investigation.
