What are the main sources of regulatory laws in your jurisdiction?

The following laws generally cover financial services in Chile:

  • The General Banking Act dated 19 December 1997 (Decree with force of Law No. 3) (“Banking Act”)
  • CMF Updated Compilation of Regulations (Recopilacion Actualizada de Normas)
  • The Chilean Central Bank Compendium of Financial Regulations (Compendio de Normas de Cambios Internacionales)
  • The Chilean Central Bank Compendium of Foreign Exchange Regulations (Compendio de Normas de Cambios Internacionales)
  • The Money Lending Act (Law No. 18,010)
  • The Fintech Act (Law No. 21,521)

In addition, depending on the type of financial services provided and the type of clients, financial services may be subject to the Consumer Protection Law (Law No. 19,496) and the Data Privacy Law (Law No. 19,628). Note that crypto-assets and cryptocurrencies are not yet regulated.
