1.1 What are the relevant statutes and codes?

Article 18 of the Constitution adopted in 1994, and amended in 2003, includes the following provisions: the state will guarantee the inviolability of a person; and no one will be subjected to torture, punishment and inhuman treatment.

Article 35 of the Constitution adopted in 1994, and amended in 2003, includes the following provisions: forced labor will not be permitted, except in cases defined by law; and using women and child labor will be prohibited in heavy and underground works and in harmful conditions.

The Law No. 954 (2013) on the Prevention of Violence in the Family (LPDV).

Article 93 of the Code of Administrative Offenses 2013 "Violation of the requirements of the legislation of the Republic of Tajikistan on the prevention of domestic violence and violation of the requirements of a restraining order."

1.2 What is the controlling case law?
None, as Tajikistan is a civil law jurisdiction, it is not precedent driven, and each case is determined on the facts of that case as they relate to the Criminal Procedure Code 2010 ("CPC 2010").
1.3 What are the specific parts of the court system that address domestic violence?

Article 8 of the CPC 2010 guarantees due process to all.

Pursuant to Article 273, paragraph 2, of the CPC 2010, courts may sit in closed session in cases involving offenses by persons under the age of 16, offenses against freedom, and sexual and other offenses, for the purpose of preventing the disclosure of information about intimate aspects of the lives of those participating in the proceedings or other information injurious to their dignity, and also in cases where this is necessary to ensure the safety of the participants in the proceedings and the witnesses, members of their families and their close relatives. Cases that are heard in closed session are held in compliance with all the rules of due process.

1.4 What are potential causes of action?

The basis for the application of measures to prevent domestic violence can be the following: a statement from the victim or information from individuals and/or legal entities; a detection of cases of domestic violence by internal affairs bodies; or information provided by other actors preventing domestic violence.
