Consent of data subjects must be obtained before cookies can be used, except for "essential cookies" which are necessary for the proper functioning of the service requested by the data subject. Consent may be expressed through appropriate settings of the online browser. However, according to a recent ruling of the Court of Justice of the European Union (C-673/17, Planet49), storing cookies requires users' active consent, which should likewise fulfill the requirements set out in the GDPR. Therefore, relying solely on an online browser's settings may prove insufficient.
