What are the key cybersecurity laws and regulations?

- There are a number of such laws impacting on this area which have been implemented at an EU level, as has been set out in the EU Chapter (e.g. Cybersecurity Act, eIDAS Regulation, NIS2 Directive, Cyber Resilience Act, DORA, PSD2 Directive etc.)
- Statutory Instrument No. 360/2018 - European Union (Measures for a High Common Level of Security of Network and Information Systems) Regulations 2018 (the “NIS Regulations”) – which transposed the EU’s Network and Information Systems Directive 2016/1148 (“NIS1 Directive”)
- The Network and Information Systems 2 Directive (EU) 2022/2555 (“NIS2 Directive”) is not yet transposed into Irish law. On 30 August 2024, the Irish Government published a draft General Scheme for the National Cyber Security Bill, which will transpose the NIS2 Directive into Irish law. However to date, no further legislative steps have been completed in respect of transposition.

- Ireland has implemented the EU’s Data Governance Act through the adoption of S.I. No. 272/2024 - European Union (European Data Governance Act) Regulations 2024 and S.I. No. 734/2024 - European Union (Data Governance Act) (No. 2) Regulations 2024.
Are new or material changes to those key data and cybersecurity laws anticipated in the near future?

As noted above there have been several legislative developments at an EU level (as discussed in the EU Chapter ) but few at a national level.
As the date to transpose the NIS2 Directive into national law was 17 October we expect this legislative change to be a priority over the next few months.
